Terms of Service

These Terms of Service ("Terms") govern your use of Pathway, a service provided by Letter Box Digital, LLC ("we", "us"). By creating an account or using Pathway, you agree to these Terms.
1. Your account
You must provide accurate information when you sign up, and keep your password secure. You are responsible for activity on your account. You must be at least 18 years old (or the age of majority where you live) to use Pathway.
2. The service
Pathway lets you create interactive maps with points of interest and embed them on websites. We provide the service "as is" — we work hard to keep it reliable, but we cannot guarantee uninterrupted access.
3. Subscription, billing, and refunds
- Paid plans are billed in advance, on a recurring basis, via Stripe.
- You can cancel your subscription anytime from your account settings. Cancellation takes effect at the end of your current billing period — you keep access until then.
- Refunds: we do not generally issue refunds for partial billing periods. We may issue refunds or credits at our discretion (for example, to make good on an outage or service issue). Email us if you believe you're owed one.
- If a payment fails, we will notify you and retry the charge. If payment cannot be collected after a reasonable retry period, we may suspend or terminate your account.
- You are responsible for any taxes that apply to your purchase, except for taxes based on our income.
4. Your content
You own the listings, points of interest, addresses, descriptions, and other content you create on Pathway ("Your Content"). You grant us a non-exclusive, worldwide license to host, store, display, and transmit Your Content solely so we can provide the service to you and to people who view your embedded maps.
You are responsible for Your Content. You confirm you have the right to upload it and that it does not infringe anyone else's rights.
5. Acceptable use
Don't use Pathway to:
- Break the law, or facilitate illegal activity.
- Harass, threaten, defame, or harm anyone.
- Upload content that is obscene, hateful, or infringes someone else's intellectual property.
- Distribute malware or attempt to compromise our systems or other users' accounts.
- Scrape, copy, or systematically extract data from Pathway except via features we provide.
- Resell, sublicense, or repackage Pathway as your own product without written permission.
- Impose unreasonable load on our infrastructure (e.g., bot traffic, automated request floods).
6. Suspension and termination
By you: you can cancel your subscription or delete your account anytime from your account settings.
By us: we may suspend or terminate your account if:
- You violate these Terms or our acceptable-use rules.
- Payment cannot be collected after reasonable retries.
- We detect fraud, abuse, or chargebacks.
- We are required to do so by law or court order.
- We discontinue the service, in which case we'll give reasonable notice and a pro-rata refund of any unused prepaid time.
For non-emergency terminations, we will give you reasonable notice when possible. For violations involving illegal content, fraud, or imminent harm, we may suspend immediately.
7. What happens to your data
- If you delete your account, your data is recoverable for 30 days, then permanently removed.
- If we terminate your account for cause, the same 30-day recovery window applies unless we are required by law to remove data sooner.
- You can request a copy of your data at any time before deletion. Email [email protected].
- We may retain limited records (financial transactions, audit logs) longer where required for legal or tax purposes.
8. Our content and intellectual property
Pathway, including its software, design, branding, and documentation, is owned by Letter Box Digital, LLC and protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use Pathway in accordance with these Terms. We reserve all rights not expressly granted.
9. Disclaimers
Pathway is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components.
10. Limitation of liability
To the maximum extent permitted by law, Letter Box Digital, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of Pathway.
Our total liability for any claim relating to Pathway will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold Letter Box Digital, LLC and its officers, employees, and contractors harmless from any claim or demand, including reasonable attorneys' fees, arising out of Your Content, your use of Pathway, or your violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or Pathway will be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email and update the "Effective" date above. Continued use of Pathway after changes means you accept the updated Terms.
14. Miscellaneous
These Terms are the entire agreement between you and Letter Box Digital, LLC concerning Pathway, and supersede any prior agreements. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
